CONVENING - ADOPTION OF AGENDA


The Mayor and Council met in regular session at 7:00 p.m. in Council Chambers. Council President Siggers called the meeting to order. The Lord's Prayer and the Pledge of Allegiance were recited.


Mayor Tilghman introduced three girl scouts from Troop 1154 who were attending the meeting working on their model citizen badge.


Mr. Webster moved to postpone Resolution No. 946 for further discussion at the April 9, 2003 work session. Mrs. Polk seconded and the vote was unanimous. The agenda, as amended, was unanimously approved.


PRESENTATION OF RECALL PETITIONS


Mrs. Brenda Cox reported that the recall petitions were not being turned in at this time.


APPROVAL OF MARCH 10, 2003 MINUTES


On a motion by Mr. Scott and seconded by Mr. Webster, the March 10, 2003 minutes were unanimously approved.


RESOLUTION NO. 945 - ACCEPTING WEED AND SEED FUNDS FOR ADDITIONAL LIGHTING IN THE CHURCH STREET NEIGHBORHOOD


Mr. Webster moved and Mrs. Polk seconded to approve Resolution No. 945. Mayor Tilghman presented Resolution No. 945 accepting $1,160 awarded through a Weed and Seed grant for additional lighting in the Church Street neighborhood.


After discussion, including Neighborhood Grant funds, Resolution No. 945 passed unanimously.


RESOLUTION NO. 947 - ACCEPTING PORTABLE ANESTHESIA MACHINE FROM THE SALISBURY ZOO COMMISSION


Mr. Webster moved and Mrs. Polk seconded to approve Resolution No. 947. Resolution No. 947, as introduced by Public Works Director John Jacobs, accepts a portable anesthesia machine (cost not exceeding $5,000) from the Salisbury Zoo Commission as a donation to the veterinary clinic of the Salisbury Zoo.


Resolution No. 947 passed unanimously.


RESOLUTION NO. 948 - APPROVING MEMORANDUM OF AGREEMENT BETWEEN WICOMICO COUNTY EMERGENCY SERVICES AND THE SALISBURY POLICE DEPARTMENT


Mr. Webster moved and Mrs. Polk seconded to approve Resolution No. 948. Police Chief Allan Webster addressed Resolution No. 948 approving a Memorandum of Agreement between Wicomico County Emergency Services and the Salisbury Police Department. It authorizes the Police Chief to sign the Memorandum of Agreement regarding the grant of domestic preparedness equipment (60 responder packs).


Resolution No. 948 passed unanimously.


RESOLUTION NO. 949 - ACCEPTING CONTRIBUTIONS FOR THE REPAIR OF THE BANDSTAND AND PEDESTRIAN BRIDGE IN THE CITY PARK


Mrs. Polk moved and Mr. Webster seconded to approve Resolution No. 949. Mayor Tilghman presented Resolution No. 949 accepting $6,070 in cash donations for the repair of the bandstand and pedestrian bridge in the City Park, as well as $5,712 for the value of donation of services by Clear Channel Outdoor and Lowe’s Homes Centers, Inc.


Resolution No. 949 passed unanimously.


RESOLUTION NO. 950 - REAPPOINTMENT TO BOARD OF DIRECTORS OF THE FRIENDS OF POPLAR HILL MANSION, INC.


Mr. Webster moved and Mrs. Polk seconded to approve Resolution No. 950. Mayor Tilghman recommended the reappointment of Mr. Edward T. (Ted) Deacon to serve on the Board of Directors of the Friends of Poplar Hill Mansion, Inc. for a term to expire December 31, 2005.


Resolution No. 950 passed unanimously.


RESOLUTION NO. 951 - APPROPRIATING FUNDS FROM THE CITY CONTINGENCY FOR HYDRILLA TREATMENT AT SCHUMAKER POND


Mr. Webster moved and Mrs. Polk seconded to approve Resolution No. 951. Public Works Director John Jacobs provided a briefing on Resolution No. 951 appropriating $6,000 from the City’s Contingency Fund to treat the hydrilla infesting Schumaker Pond.


After discussing the use of the generic chemical to treat the hydrilla, Resolution No. 951 passed unanimously.


REQUESTS FOR ANNEXATION:


Public Works Director John Jacobs highlighted the following requests for annexation:


W. Naylor Mill-Interfaith Housing Annexation

          23.2 acres (parcel 325 on assessment map) located along the southerly side of W. Naylor Mill Road and binding along the westerly side of Leonard Pond Run;

          1.5 acres owned by City of Salisbury to be included in annexation (adjoins easterly side of the Interfaith property;

          currently zoned R-20 Residential in the County and lies within the Paleochannel Overlay District;

          proposed zoning classification of R-5A Residential upon annexation;

          developer plans to construct 105 senior resident apartments on parcel 325; and

          public hearing to be scheduled for April 14, 2003.


Onley Road-Cedar Crossing Addition Annexation

          3 acres (adjacent to the easterly side of Cedar Crossing Subdivision) located along the northerly side, but not binding upon, Onley Road;

          currently zoned R-15 Residential in the County;

          proposed zoning classification of R-8A upon annexation;

          property to be developed as an addition to Cedar Crossing Subdivision consisting of three single-family homes and seven duplexes totaling seventeen residential units; and

          public hearing to be scheduled for April 14, 2003.


U.S. Route 50 East - Milford Street Associates Annexation

          3.9 acres fronting along the westerly side of Carolyn Avenue, northerly side of U.S. Route 50 East and the southeasterly side of the future extension of Beaglin Park Drive;

          property fronting Carolyn Avenue currently zoned R-15 Residential in the County;

          remaining property along U.S. Route 50 and the Beaglin Park Drive extension currently zoned LB-1 Light Business and Institutional in the County;

          proposed zoning classification of Neighborhood Business District upon annexation;

          development plans include professional, medical and financial offices; and

          public hearing to be scheduled for April 28, 2003.



After discussion, there was a consensus by the Council to proceed with the preparation of a resolution for each of the proposed annexations.


PUBLIC COMMENTS


Members from the audience expressed comments on the following issues: 1) traffic control in parking lots/garage; 2) emergency fire protection system in parking garage; 3) House Bills 815 and 281 regarding slot machines; 4) annexations; and 5) recall petitions.

No comments.


COUNCIL COMMENTS


Mr. Webster thanked Access 26 and complimented the Salisbury Police Department for their efforts in the recent drug bust. Messrs. Scott and Day referred to The Daily Times article on the drug bust and opined that it should have been on page one instead of page eleven. Mrs. Polk commented on the events facing our nation and the sacrifices others are making for us.


COUNCIL PRESIDENT WRAP-UP


Ms. Siggers mentioned that it was brought to her attention that a number of families were being put out of their homes in the Camden and surrounding area (being told that properties will be used as student rentals). Ms. Siggers recognized the Public Works Department for their expediency in changing the curbing for wheelchair accessability along Riverside Drive. Ms. Siggers also explained the recall process and expressed her appreciation for the petitions not being turned in one or two at a time.


MOMENT OF PRAYER


Rev. Harvey Dixon shared a moment of prayer for all those individuals making sacrifices for our country during this time of war.
