RESOLUTION NO. 1354
A RESOLUTION OF THE COUNCIL OF THE
CITY OF SALISBURY, MARYLAND REQUESTING THAT THE MARYLAND DEPARTMENT OF
TRANSPORTATION RELEASE TRANSPORTATION TRUST FUND GRANTS THAT WERE SET ASIDE BY
THE GENERAL ASSEMBLY TO BE DISTRIBUTED TO UNITS OF LOCAL GOVERNMENT FOR
“CAPITAL RELATED PROJECTS” IN FY 06
WHEREAS, the Maryland General
Assembly, in its 2005 session, appropriated Transportation Trust Fund funds to
be distributed to units of local government based on Highway User Revenue distribution formulae; and
WHEREAS, the General Assembly set
aside these funds to be used by units of local government for “capital related
projects… which have a useful life of at least 15 years and a cost in excess of
$50,000”; and
WHEREAS, the General Assembly mandated
that the Maryland Department of Transportation establish rules for the award of
these capital grant funds to units of
local government; and
WHEREAS, the Maryland Department of
Transportation has not yet established such rules; and
WHEREAS, the Secretary of the
Department of Transportation has now indicated that these funds may not be
distributed to the intended units of local government; and
WHEREAS, if
the Secretary of the Department of Transportation does not distribute these
funds to the intended units of local government, that action would be counter
to the mandate of the General Assembly; and
WHEREAS, the
City of Salisbury will lose $96,724 if these funds are not distributed by the
Secretary of the Department of Transportation;
NOW, THEREFORE, BE IT RESOLVED that
the Salisbury City Council requests that the Secretary of the Department of
Transportation immediately take the necessary steps to release the “capital
project” grant funds that were set aside by the 2005 General Assembly to be
distributed to units of local government..
THE ABOVE RESOLUTION was introduced
and duly passed at a meeting of the Council of the City of Salisbury, Maryland
held on the 23rd day of January, 2006 and is to become effective
immediately upon adoption.
