CITY OF SALISBURY, MARYLAND

CONVENING - ADOPTION OF AGENDA

The Mayor and Council met in regular session at 7:00 p.m. in Council Chambers. Council Vice
President Scott called the meeting to order. The Lord's Prayer was repeated and the Pledge of
Allegiance was recited.

Mrs. Polk moved and Mr. Stacey seconded to adopt the agenda as presented. City Solicitor Paul
Wilber recommended that the public hearing on Ordinance No. 1802 be pulled from the agenda
due to an illness in the applicant's family.

Mr. Stacey moved and Mrs. Polk seconded to pull Ordinance No. 1802 from the agenda and
bring it back at the next Council meeting. The agenda, as amended, was unanimously adopted.

APPROVAL OF MINUTES - JANUARY 22, 2001

On a motion by Mrs. Polk and seconded by Mr. Stacey, the minutes of January 22, 2001 were
unanimously approved.

ORDINANCE NO. 1798 - 2ND READING - TERMINATING CANAL PARK DRIVE AT ITS
TERMINUS

Mr. Stacey moved and Mrs. Polk seconded to approve Ordinance No. 1798, terminating Canal
Park Drive at its terminus. City Solicitor Paul Wilber related that Ordinance No. 1798 would
close a portion of Canal Park Drive, but the City would retain an easement to place utilities in
that area.

Ordinance No. 1798 for second reading passed unanimously.

ORDINANCE NO. 1799 - 2ND READING - PROPOSED CHANGE TO NUMBER OF
APPROVED SIGNS FOR MALLARD LANDING PRD #6

Mr. Stacey moved and Mr. Webster seconded to approve Ordinance No. 1799, a proposed
change to the number of approved signs for Mallard Landing PRD #6. Planning & Zoning
Director David Nutter presented Ordinance No. 1799 and recommended approval of the change
(entrance sign on S. Schumaker Drive and identification sign at the Johnson Road service
entrance).

Ordinance No. 1799 for second reading passed unanimously.

ORDINANCE NO. 1800 - 1ST READING - BUDGET AMENDMENT ACCEPTING THE
DONATION OF FUNDS ($200,000) FROM FRANK AND MITZI PERDUE FOR THE
BOUNDLESS PLAYGROUND TO BE LOCATED IN NEWTOWN PARK

Mr. Stacey moved and Mrs. Polk seconded to approve Ordinance No. 1800, accepting a
donation of $200,000 from Frank and Mitzi Perdue for a Boundless Playground to be located in
Newtown Park.

Ordinance No. 1800, as introduced by Mayor Tilghman and Ms. Deborah Stam, accepts the
matching funds for the universally accessible playground in Newtown Park, located on the
corner of Poplar Hill Avenue and Broad Street. Ten grants were available through the State for
a Boundless Playground. Baltimore City received a $200,000 grant. Salisbury was one of two
recipients for a $100,000 grant. The remaining grants were $75,000. Salisbury was also the
only city on the Eastern Shore that received a grant. Even though the City did not receive a
$200,000 grant, Frank and Mitzi Perdue stuck to their original commitment of $200,000.

Ordinance No. 1800 for first reading passed unanimously.

RESOLUTION NO. 754 - APPROVING MUTUAL AID AGREEMENT WITH SALISBURY
STATE UNIVERSITY

Mr. Stacey moved and Mrs. Polk seconded to approve Resolution No. 754, approving a mutual
aid agreement with Salisbury State University. Major Jeff Livingston explained that the
agreement includes the law enforcement agencies surrounding Salisbury State University and
stipulates the circumstances in which police officers may exercise their authority.

After a brief discussion, Resolution No. 754 was unanimously approved.

RESOLUTION NO. 755 - APPROVING AGREEMENT BETWEEN THE CITY OF
SALISBURY AND WICOMICO COUNTY FOR THE CITY'S REAL PROPERTY TAX
BILLING

Mr. Stacey moved and Mrs. Polk seconded to approve Resolution No. 755, approving an
agreement between the City of Salisbury and Wicomico County for the City's real property tax
billing. Finance Director John Cawley presented Resolution No. 755 for Council's approval.

Mrs. Polk asked that items 6 and 7 be reversed in the agreement. Resolution No. 755 passed
unanimously.

ORDINANCE NO. 1801 - 1ST READING - BUDGET AMENDMENT - APPROPRIATING
$16,500 FOR THE TAX BILLING REPROGRAMMING COSTS

Mr. Stacey moved and Mr. Webster seconded to approve Ordinance No. 1801, appropriating
$16,500 for the tax billing reprogramming costs. Ordinance No. 1801, as briefed by Finance
Director John Cawley, provides funding ($16,500) for programming the County's tax billing
software to render the City's real property taxes.

Ordinance No. 1801 for first reading passed unanimously.

On a motion by Mrs. Polk, and seconded by Mr. Stacey, the above items were unanimously
approved.

MAYOR'S COMMENTS

Mayor Tilghman commented on the following:

  • meeting with Eastern Shore delegation last week in Annapolis -- a time will be scheduled to meet with Congressman Gilchrest concerning water and sewer;
  • spoke with the Governor and Lt. Governor regarding some of the plans for Salisbury;
  • testifying at a hearing in Annapolis tomorrow on behalf of the Community Legacy Program;
  • Pinehurst Neighborhood meeting scheduled for 7:00 p.m. on February 13, 2001 at the Pinehurst Elementary School;
  • Mayor's Association lunch with Baltimore City Mayor O'Malley last Friday; and
  • citizen-based budget meeting scheduled for February 27, 2001 at Bethany Lutheran Church.
COUNCIL COMMENTS

The Council thanked everyone for attending.

PUBLIC COMMENTS

Mr. James Trader asked for the name of the custodian of records for the wastewater treatment
plant in order to obtain information concerning the recent EPA action. Mr. Trader commented
on the storm water drainage plans for Pemberton Elementary School and his concern on the
impact on the river.

COUNCIL VICE PRESIDENT WRAP-UP

Council Vice President expressed his appreciation to those individuals attending the Council
meeting.

With no further business, the meeting adjourned at 7:35 p.m.

The City Council met at 1:00 p.m. in Room 300 of the City/County Government Building. Mrs.
Polk moved and Mr. Scott seconded to convene in Closed Executive Session for the purpose of
conducting the interviews for the Fire Chief position. Ms. Siggers, Mrs. Polk and Mr. Scott
voted aye. Mr. Webster voted nay and Mr. Stacey abstained.

After three of the five candidates were interviewed by the City Council, Mrs. Polk moved to
adjourn the closed session at 2:40 p.m. Mr. Scott seconded and the vote was unanimous.

voted aye. Mr. Webster voted nay and Mr. Stacey abstained.

After the two candidates were interviewed by the City Council, Mrs. Polk moved to adjourn the
closed session at 3:22 p.m. Mr. Scott seconded and the vote was unanimous.
