CITY OF SALISBURY, MARYLAND

#20 MEETING                                                                                                                     OCTOBER 22, 2001

CONVENING - ADOPTION OF AGENDA

The Mayor and Council met in regular session at 7:00 p.m. in Council Chambers. Council President Stacey called the meeting to order. The Lord's Prayer was repeated followed by Boy Scout Troop 478 leading the Pledge of Allegiance.

Mr. Webster moved to delete Ordinance No. 1826, ordinance permit to establish a day care center on 326 Delaware Avenue, from the agenda. Mr. Webster preferred to resolve the legal issues relating to a day care property rezoning court case before considering any additional day care center requests. He believed the Council needed to readdress the legalities discussed at last Thursday's work session. Mr. Scott seconded the motion. Ms. Siggers acknowledged that she would abstain from voting on the motion since she was not aware of any issues one way or the other. All voted in favor of deleting Ordinance No. 1826 from the agenda with the exception of Ms. Siggers who abstained.

Mr. Stacey announced that the City Council would convene in a Closed Executive Session after the Award of Bids to discuss these legal issues with the City Solicitor. After further discussion, all voted in favor of the agenda, as amended, with the exception of Ms. Siggers' nay vote.

APPROVAL OF OCTOBER 8, 2001 MINUTES

On a motion by Mr. Webster and seconded by Mrs. Polk, the minutes of October 8, 2001 were unanimously approved.

PROCLAMATIONS

Proclamations were presented by Mayor Tilghman proclaiming November 2001 as "Hospice Month" and October 23, 2001 as "Parkside High School Automotive Technology Program Day" in the City of Salisbury. Ms. Alice O'Neill and Mr. Jim Fineran accepted the proclamation on behalf of Coastal Hospice. Messrs. Andy Buchanan, Tom Fields, Dean Forster and Dave White accepted the proclamation on behalf of Parkside High School.

ORDINANCE NO. 1824 - 2ND READING - AMENDING SECTION 13.04.060, COMPUTATION OF SEWER CHARGES, OF THE SALISBURY MUNICIPAL CODE BY INCREASING THE ANNUAL FLAT RATE SEWER RATES

Mrs. Polk moved and Ms. Siggers seconded to approve Ordinance No. 1824 for second reading. Finance Director John Cawley explained that Ordinance No. 1824 increases the annual flat rate sewer charges for those customers (approximately 181) having wells.

After a brief discussion, Ordinance No. 1824 for second reading was unanimously approved.

RESOLUTION NO. 798 - REAPPOINTMENT TO PLANNING & ZONING COMMISSION

Mrs. Polk moved and Ms. Siggers seconded to approve Resolution No. 798. Mrs. Gloria Smith, Planning & Zoning Department Planner, submitted the reappointment of Mr. Donald B. Bounds to a five-year term to expire April 15, 2006. Mr. Bounds serves as the Vice Chairman of the Commission.

Resolution No. 798 passed unanimously.

MANUFACTURING EXEMPTION REQUEST - ADVANTAGE COLOR LABS, INC.

Ms. Siggers moved and Mrs. Polk seconded to approve the manufacturing exemption request for Advantage Color Labs, Inc. Finance Director John Cawley presented Advantage Color Labs request for an exemption from personal property tax for their equipment purchased in 1999 and 2000. Over the next five years, a maximum of $3,871 in personal property tax would be waived.

After discussion, the manufacturing exemption request for Advantage Color Labs, Inc. was unanimously approved.

AWARD OF BIDS

Ms. Siggers moved and Mrs. Polk seconded to approve the Award of Bids. The following items were presented for approval by Director of Procurement & Parking Carol Turner:

1.    Declaration of Surplus (1995 printer and 1992 computer monitor)...................................................... -0-
2.    Contract No. 106-02
       Side-Load Automated Refuse Truck (001-3315-532.70-20)
       Elliott Wilson Equipment Co............................................................................................... $142,421.00

Ms. Siggers moved and Mr. Webster seconded to approve the items as a group. The above items were unanimously approved.

CLOSED EXECUTIVE SESSION
OCTOBER 22, 2001

TIME & PLACE:                     7:38 p.m., Room 301 - City/County Government Building
PURPOSE:                              Consult with City Solicitor on a legal issue (day care center property rezoning case)
VOTE TO CLOSE:                 Unanimous

                                               City Solicitor Paul Wilber

At 7:38 p.m. in Room 301 of the City/County Government Building, Mr. Scott moved to convene in Closed Executive Session for the purpose of consulting with the City Solicitor regarding the legal issues of a day care property rezoning court case with the City Solicitor as permitted under the Annotated Code of Maryland Sections 10-508(a)(7)(8). Mr. Webster seconded and the vote was unanimous.

After discussing the legal aspects and appeal avenues of the court case with the City Solicitor, Mr. Wilber was given direction by the City Council on how to proceed.

At 8:40 p.m., upon a motion and a second by Ms. Siggers and Mrs. Polk respectively, the closed session was unanimously adjourned to reconvene in open session.

With no further discussion in open session, the October 22, 2001 meeting adjourned at 8:41 p.m.

At 9:22 p.m., in Room 305 of the City/County Government Building, Mr. Scott moved to convene in Closed Executive Session to discuss a personnel issue as permitted under the Annotated Code of Maryland Section 10-508(a)(1). Mr. Webster second and the vote was unanimous.

After discussing the issue involving the employee and the letter received from the Mayor concerning that matter, Mr. Scott moved to adjourn the closed session. Mr. Webster seconded and the vote was unanimous. The closed session adjourned at 9:36 p.m. and Council reconvened in open session.
