v                  Assisted in continued support of the development of Urban Salisbury, Inc., as a 501(C)(3) partnership for the revitalization of Salisbury’s urban core, and continued support for Main Street Maryland Activities.

REVIEW AND ANALYSIS

 

 

   I.    Planning Department - Responsibilities

 

          A.      Planning and Zoning

 

                             Since 1943, the City of Salisbury and Wicomico County have cooperated in conducting a joint planning program.  In the early 1960’s the two jurisdictions established a separate planning office to oversee planning and zoning activities.  In response to the dramatic changes that have occurred in both the City and County over the past many years, the former Planning Office was designated in 1989 as the Salisbury/Wicomico Department of Planning, Zoning and Community Development.

 

MISSION

 

          The department directly benefits the citizens of both the City and County in a variety of ways.  Specifically, these are:

 

1.       It endeavors to achieve cooperative agreements between the City and County on vital planning matters.

 

2.       It serves as planning and zoning advisers to the legally established City and County Planning and Zoning Commission and any other group designated by the County or City Council.

 

3.       The department conducts background studies, proposes code amendments and instigates other related evaluations for those activities requested by the Planning and Zoning Commission, the County Council, or the Mayor and City Council.

 

4.       The department is specifically authorized by local charter to perform various duties that are required under State law to assist municipalities that may participate in a County-wide program.

 

5.       The department compiles background data and monitors development trends in both the City and County which influence both the short term and long range development of both jurisdictions.

 

6.       The department oversees the periodic review, evaluation and update of the City and County Comprehensive Plans, Zoning Ordinances and other regulatory measures related to these documents.

 

7.       The department serves as a direct “line” agency to the County Council, to administer housing grants and other related programs, community development block grants, and agricultural land preservation grants.

 

8.       The department serves as the enforcement agency for the State’s required Chesapeake Bay Critical Area Program and Forest Conservation Program for the City and County as well as the County Zoning Code and portions of the County nuisance ordinance.

 

9.       The department assists in the preparation of plans for Planning Commission review and recommendation to the Mayor and City Council; upon request serves as technical staff to the Commission and Council in matters relating to Historic Zoning and Urban Renewal and general Neighborhood improvement or protection programs.

 

10.     The department has routine administrative duties which include meeting arrangements, preparations for public hearings, technical advice to citizens, special interest groups, and developers; maintains all correspondence, minutes and records for the Planning Commission, City Board of Zoning Appeals, and County Board of Appeals.

 

11.     The department provides information to potential developers, and to the general public pertaining to zoning, development sites and trends, and provides maps and statistical information of various kinds.

 


II.      Annual Operating Program

 

          A.      Planning and Zoning - City

 

1.       Formulate planning and community development strategies for downtown and neighborhood revitalization.

 

2.       Implement the City’s Chesapeake Bay Critical Area Program.

 

3.       Work with the Planning Commission and Mayor and City Council to implement the transportation and growth strategies for the City.

 

4.       Work with various citizen groups and task forces on revitalization activities upon request.

 

5.       Prepare background data for Neighborhood Planning activities as requested.

 

6.       Document changes on the City’s development patterns and population shifts.

 

7.       Continue to recommend revision of City of Salisbury’s Zoning Code.

 

8.                 Subdivision plat reviews for City.

 

9.                 Preparation of studies and recommendations for Zoning and Subdivision Code amendments.

 

10.     Administrative duties and case reports for the City Historic District Commission.

 

11.     Administrative duties and case reports for Board of Zoning Appeals.

 

12.     Preparation of studies, follow-up and inspections and related administrative duties for the Planning Commission.

 

13.     Provide information to potential developers, prospective and existing businesses and the general public.

 

14.     Review and update of Comprehensive Plans and state mandated Economic Growth Act.

 

15.     Coordinate Census data and Census tracts area designations.

 

16.     Conduct zoning and plan analysis on all annexation requests.

 

III.    Activities and Accomplishments

13.   Coordinate revitalization efforts with the Weed and Seed Program initiatives.

 

14.   Coordinate Urban Salisbury, Inc. activities.

 

15.   Administer USDA-Rural Business Enterprise Grant (RBEG) for City of Salisbury.

 

16.   Assisted with the preparation of the Community Legacy Application.

 

17.   Coordinate Main Street Maryland activities.

 

 

B.      Day to Day Planning and Zoning Activities of the Staff and Planning Commission

 

The Planning Commission held three (3) regular meetings and two (2) special meeting during this quarter.

 

The Commission held Public Hearings or reviewed and made recommendations on the following matters.  The Planning Staff coordinated with other City Departments and prepared detailed reports in regards to each of the following:

Co. – North Salisbury Boulevard – General Commercial District - #SP-0314-04C – M-29, P-5477 & 5478, G-6 – The Commission TABLED the above mentioned case to allow representation to be present at the meeting.

 

                   REVISED FINAL COMPREHENSIVE DEVELOPMENT PLAN – Ponds at Pemberton – Martin/Ruark, LLC – 96 Housing Units – Pemberton Drive - #SP-0420 – M-37, P_145, G-17 – The Commission APPROVED the Final Comprehensive Development Plan for Martin/Ruark, LLC, including a WAIVER from submission of a Community Impact Statement and Statement of Intent to Proceed and Financial Capability and subject to the Conditions of Approval.

 

                   Ponds at Pemberton – Preliminary – 96 Lots – Pemberton Drive – The Commission APPROVED the Preliminary/Final subdivision plat for the Ponds at Pemberton, subject to the Conditions of Approval.

 

                   REVISED PRELIMINARY COMPREHENSIVE DEVELOPMENT PLAN – Canal Woods – To remove swim club and construct 56 Condominium units – Canal Woods Drive – R-5A Residential District - #SP-8604-05D – The Commission APPROVED the Preliminary Condominium Site Plan for Canal Woods, subject to the Conditions of Approval.

 

FINAL COMPREHENSIVE DEVELOPMENT PLAN – Dale Dashiell/Milford W. Twilley, Inc.- Mt. Hermon Road & St. Alban’s Drive – St. Alban’s Commons PRD #9 - #SP-0110-03A – M-121, P-2505, G-21 – The Commission APPROVED the Final Comprehensive Development Plan for St. Alban’s Commons PRD #9, Pad #9, subject to the Conditions of Approval.

 

                   PRELIMINARY COMPREHENSIVE DEVELOPMENT PLAN – Vantage Retirement Living – Johnson Road – 230 Housing Units - #SP-0520 – M-48, P-282, 285 & 415, G-5 – The Commission APPROVED the Preliminary Comprehensive Development Plan for Vantage Point Retirement Living, subject to the Conditions of Approval.

 

SALISBURY – NAYLOR MILL – RUARK/CANNON ANNEXATION – Zoning Recommendation – 12.44 Acres – M-29, P-417, G-18 – The Commission forwarded a FAVORABLE recommendation to the Salisbury City Council and the Wicomico County Council for R-10A Residential zoning for the Ruark property upon annexation to the City of Salisbury.  This zoning classification is not a low density classification but the density of apartment development now permitted in the adjoining County R-8 Residential District is 12 units per acre.  The Commission also recommended that a Comprehensive Development Plan be submitted for review and approval for development of this property.

 

PRELIMINARY COMPREHENSIVE DEVELOPMENT PLAN – The Villages at Parsons Lake, Section 2 – Thomas H. Ruark – East Naylor Mill Road – R-10A Residential – #SP-0408-05A – M-30, G-7, P-223 & 398 – The Commission APPROVED the Preliminary Comprehensive Development Plan for The Villages At Parsons Lake, Section 2, subject to the Conditions of Approval.

 

SIGN PLAN AMENDMENT – GROUND SIGN – Centre at Salisbury Mall/Regal Theaters – N. Salisbury Blvd. – General Commercial – #SP-8713-04Y – M-119 G-15, P-237 – The Commission APPROVED the Revised Ground Sign format and colors as submitted.

 

SALISBURY – SOUTH DIVISION STREET/CAREY ANNEXATION – Zoning Recommendation – 1.0 Acres – M-48, P-221 & 222, G-8 – The Commission forwarded a FAVORABLE recommendation to the Salisbury City Council and the Wicomico County Council for Neighborhood Business zoning on the Carey properties upon annexation to the City of Salisbury.  The Commission recommended that a Comprehensive Development Plan be submitted for review and approval by the Planning Commission.

 

The Preserve at Aydelotte Farm – Final – 61 Lots – Middle Neck Drive – The Commission APPROVED the Final Plat for The Preserve at Aydelotte Farm, subject to the Conditions of Approval.

 

CONDOMINIUM SITE PLAN – The Plaza Gateway Building – Palmer Gillis, represented by George, Miles & Buhr – 116-118 W. Main Street – Central Business District - #SP-0521 – M-107, G-17, P-1054 – The Commission APPROVED the Condominium Site Plan for The Plaza Gateway Building, subject to the Conditions of Approval.

 

SIGN PLAN – ERA Martin & Assoc., represented by Selby Sign Co. – U.S. Route 50 & E. Main Street – Light Business & Institutional District - #SP-0505 – M-108, G-11, L-9 – The Commission APPROVED the Sign Plan for ERA Martin & Associates as submitted.

 

                   SIGN PLAN – Pemberton Pharmacy – Pemberton Drive & Parsons Road - #SP-0015-05A – M-106, P-3292, G-7 – The Commission APPROVED the Sign Plan for Pemberton Pharmacy as submitted.

 

SIGN PLAN AMENDMENT – Shoppes at Salisbury – Tim’s Pizza & Subs, represented by AAA Wholesale Lighted Signs – Tilghman Road - #SP-8702-04M – M-110, G-9 & 10, P-4482 – The Commission DENIED the Sign Plan Amendment (to add the color green) for Tim’s Pizza & Subs in the Shoppes at Salisbury center.  The Commission suggested that the green on this sign be changed to the color red, an approved color in the Sign Plan for the shopping center.  The color modification to the existing sign panel shall be completed within 45 days from the date of this letter.

 

                   CERTIFICATE OF DESIGN & SITE PLAN APRPOVAL – Riverside Condominiums – Dr. Michael Tilghman, represented by Wes Burton - #SP-0105-05A – Riverside Drive – Central Business District – M-111, G-3 & 9, P-p/o 1490 – The Commission APPROVED the Preliminary Certificate of Design and Site Plan for The Admiral’s Club, subject to the Conditions of Approval.

 

REVISED PRELIMINARY COMPREHENSIVE DEVELOPMENT PLAN – Westbrooke Apartments – Request to Reduce Parking Provided – Delaware Avenue – R-5A Residential District - #SP-0519 – The Commission WAIVED the parking requirements to allow provision of 192 parking spaces for the proposed apartment development.  This decision is based on the language of Section 17.180.040 of the Code, which permits the Commission to deviate from the strict requirements of the Code.  In making its decision, the Commission also noted that the project is 100 % tax credit affordable housing development.

 

                   PRELIMINARY COMPREHENSIVE DEVELOPMENT PLAN – John Crockett – 5,700 sq. ft. Commercial Building – Pemberton Drive – Neighborhood Business District - #SP-0522 – The Commission APPROVED the Preliminary Comprehensive Development Plan for Skipjack’s Seafood, including a WAIVER of the Community Impact Statement and Statement of Intent to Proceed and Financial Capability, and subject to the Conditions of Approval.

 

                   Glen Heights – Final – 90 Lots – Glen Avenue – The Commission APPROVED the Preliminary/Final Plat for Glen Heights, subject to the Conditions of Approval.

 

PRELIMINARY COMPREHENSIVE DEVELOPMENT PLAN – Milford Street Associates – Belmont Avenue – Light Business and Institutional District - #SP-0311-05B – M-38, P-304, G-12 and M-117, P-2580, G-14 – The Commission APPROVED the Revised Final Comprehensive Development Plan for Milford Street Associates, including a WAIVER of the Community Impact Statement and Statement of Intent to Proceed and Financial Capability and subject to the Conditions of Approval.

 

REVISED CERTIFICATE OF DESIGN AND SITE PLAN APPROVAL – 500 Riverside Drive, represented by Parker & Associates – Riverside Drive – Central Business District – #SP-0503 – M-111, G-4, P-1500 – The Commission APPROVED the Certificate of Design and Site Plan for the amended 500 Riverside Drive Plan, subject to the Conditions of Approval.

SIGN PLAN AMENDMENT – Chick-Fil-A, represented by Clayton Signs – Tilghman Road - #SP-9806-05I – M-110, G-9 & 10, P-4482 – The Commission APPROVED the following Sign Plan Amendments:

1.                                         Approval of the wall sign for the rear of the Chick-Fil-A building.

2.                                         Approval of a ground sign containing only the Chick-Fil-A name and logo not exceeding 5 ft. in height or 32 sq. ft. in sign surface area.

REVISED FINAL COMPREHENSIVE DEVELOPMENT PLAN/LANDSCAPING PLAN/SIGN PLAN – Apple Drugs, rep. by Innovative Property Solutions – 1500 Pemberton Drive – Harbor Pointe PRD #3B - #SP-8612-05F – M-113, P-1134, G-19 – The Commission APPROVED the following requests, subject to the Conditions of Approval:

1.                 Approval of the Revised Site Plan for reversal of the traffic flow for the drive-thru lane with a waiver of two stacking spaces in the lane.

2.                 Approval of the addition of the two pole lights in the parking lot provided the units are limited to 20 ft. in height and cut-off fixtures so as not to direct glare on adjoining streets or properties and consideration being given to using the decorative fixtures similar to those existing in Harbor Pointe.

3.                 Approval of the Revised Landscaping Plan to allow selective removal of 30 pine trees and the privet hedge and incorporating the planting schedule for the area around the remaining pine trees.

4.                 Tabling of the Revised Sign Plan to allow the applicant’s to consider creation of a design that is in keeping with the 50 sq. ft. surface area limitation of the Code.

5.                 Approval of the colors red and blue into the Sign Plan color palette.

6.                 Approval of the shopping center name change to Harbor Pointe Plaza.

 

C.      City Board of Zoning Appeals

 

The Board held one (1) regular meeting and held public hearings to consider the following applications.  The Planning Staff prepared an analysis and evaluation of each of the following:

 

                   Michael A. Matonak – 5 ft. Rear Yard Setback Variance To Construct a 20 ft. by 24 ft. shed – 1805 Emerson avenue – R-10 Residential District - #SA-0513 – The Board DENIED the requested 5 ft. Rear Yard Setback Variance based on the criteria listed in Section V(c) of the Staff Report.

K-LO Enterprises, LLC – 4 ft. Front Yard Setback Variance To Construct a 10 ft. by 12 ft. Deck – 613 Lakeside Drive – R-8 Residential District - #SA-0514 – The Board TABLED the requested Front Yard Setback Variance to allow determination by the Building Department on whether a variance was needed.

 

                   Quarles Petroleum, Inc. – Special Exception to Construct and Operate a Gasoline Service Facility – 1616 Northwood Drive – Light Industrial District - #SA-0515 – The Board APPROVED the Special Exception to construct a gasoline service facility at this location, based on the criteria listed in Section V(c) of the Staff Report and subject to the Conditions of Approval.

 

D.                City Chesapeake Bay Critical Area Projects

 

The Chesapeake Bay Critical Area staff has reviewed three (3) projects and performed one (1) compliance review.

 

Parker & Associates – Intensely Developed Area – M-111, P-1500 – Meet with design engineers to discuss a proposed residential development project, 500 Riverside, and it’s compliance with Salisbury’s Chesapeake Bay Critical Area Program.

 

E.                 City Forest Conservation Projects

 

Forest Conservation staff reviewed one (1) project within the City, issued 21 Exemption certificates and performed site inspections on 3 project sites.

 

Projects reviewed:

Bank of Delmarva

 

Reviewed the above projects to verify compliance with the Maryland Forest Conservation Act.  Conducted field visits to verify existing conditions.  Reviewed Forest Conservation Delineations and Plans, made comments to engineers concerning compliance issues.

 

F.                 Salisbury Historic District Commission:

 

The Commission held three (3) regular meetings and one (1) special meeting during the quarter.  The Planning Staff prepared an analysis and evaluation for each of the 14 new applications received during this time period and assisted the Commission in the review of 3 applications submitted for reconsideration.

 

Keith A. Johnson – 111 Walnut Street – Newtown Historic District – Permission to replace front exterior door.  The Commission tabled this case due to Commission concerns.

Bethesda U.M. Church, rep. by Matt Phillips, Phillips Signs, Inc. – 406 N. Division street – Newtown Historic District – Amended Ground Sign proposal.  The Commission approved the application as submitted, according to the Salisbury Municipal Code, Section 17.52.080 and the SHDC Guidelines for Rehabilitation and Maintenance, subject to the Condition of Approval.

Shore Bank – 100 W. Main Street – Downtown Historic District – Permission to add seagull logo to the existing bank wall signs.  The Commission approved the application as submitted, according to the Salisbury Municipal Code, Section 17.52.080 and the SHDC Guidelines for Rehabilitation and Maintenance.

Amber Nicole’s Bridal & Formal – rep. by Dennis Lord – 111 Baptist Street – Downtown Historic District – Permission to install wall sign and gooseneck lighting.  The Commission approved the application as submitted, according to the Salisbury Municipal Code, Section 17.52.080 and the SHDC Guidelines for Rehabilitation and Maintenance.

Gerald Elmer – 323 Poplar Hill Avenue – Newtown Historic District – Permission to replace all windows with vinyl replacement windows.  The Commission approved the application as submitted, with conditions, according to the Salisbury Municipal Code, Section 17.52.080 and the SHDC Guidelines for Rehabilitation and Maintenance.

L. Jason Bookmeyer – 807 Smith Street – Camden Historic District – Permission to install EIFS (Exterior Finish Insulating System) over existing siding.  The Commission did not hear the case due to the applicant not appearing.

Davina Grace Hill – 605 N. Division Street – Newtown Historic District – Permission to modify rear of home with new entrance, deck, and wheelchair lift.  The Commission approved the application as submitted, with conditions, according to the Salisbury Municipal Code, Section 17.52.080 and the SHDC Guidelines for Rehabilitation and Maintenance and subject to the Conditions of Approval.

Keith A. Johnson – 111 Walnut Street – Newtown Historic District – Permission to replace front exterior door.  The Commission accepted withdrawal of the request to allow the applicant to come back with a drawing for a door that fits the original door opening, not a pre-hung door.

Donald Copes – 230 Ohio Avenue – Camden Historic District – Plan for reconstruction/rehabilitation of porch.  The Commission accepted postponement of this case.

Rainbow Partnership, LLP – 608 Light Street – Camden Historic District – Permission to install vinyl siding and vinyl replacement windows.  The Commission tabled the application as submitted according to the Salisbury Municipal Code, Section 17.52.080 and the SHDC Guidelines for Rehabilitation and Maintenance.

Les Lutz – 309 Lester Court – Newtown Historic District – Permission to install privacy fencing, construct a new front stoop, and remove existing siding and restore wood siding.  The Commission approved the application as submitted according to the Salisbury Municipal Code, Section 17.52.080 and the SHDC Guidelines for Rehabilitation and Maintenance.

Bethesda U.M. Church, rep. by Matt Phillips, Phillips Signs, Inc. – 406 N. Division street – Newtown Historic District – Amended Ground Sign proposal.  The Commission approved the amended proposal for the Ground Sign.

Port Exchange Joint Venture, rep. by Becker Morgan Group, Inc. – 312 West Main Street – Downtown Historic District – Permission to install a 32 sq. ft. aluminum ground sign.  The Commission approved the Sign request as submitted.

Addictions Associates – 323 Broad Street – Newtown Historic District – Permission to retain a wooden sign installed on this property.  The Commission tabled the Sign request until the February meeting to allow the applicant to modify the proposal.

Amber Nicole’s Bridal & Formal – rep. by Dennis Lord – 111 Baptist Street – Downtown Historic District – Permission to install a wooden wall sign near the entrance doors.  The Commission approved the Sign request as submitted.

Evelyn B. Holman, rep. by I.P.M./Debbie Wolf – 108 Wilson Street – Newtown Historic District – Permission to retain/install vinyl replacement windows with metal trim; Permission to replace wooden front door.  The Commission tabled the request to allow the applicants to submit more evidence regarding the condition of the windows proposed for replacement.

Rinnier Management, LLC, rep. by Phillips Signs, Inc. – 216 East Main Street – Downtown Historic District – Permission to install an illuminated entrance awning.  The Commission approved a non-illuminated canvas awning maintaining the existing entrance lighting.

Staff members attended the regular and special meetings of the City and County Councils, the Planning Commission and the Board of Zoning Appeals.  Additional meetings reflect current activities and projects now under way, as well as activities of other agencies and committees that may affect City and County Planning.
