ORDINANCE NO. 1970
AN ORDINANCE ENACTED BY THE CITY COUNCIL OF THE CITY
OF SALISBURY, MARYLAND, TO AMEND SECTION 1.16.100 - WAIVER OF FEES - AUTHORITY
TO ISSUE CITATIONS - VIOLATIONS AND PENALTIES - REPEALER OF THE CITY CODE TO
INCLUDE THE DEPARTMENT OF BUILDING, PERMITTING AND INSPECTION AND THE
DEPARTMENT OF NEIGHBORHOOD SERVICES AND CODE COMPLIANCE.
WHEREAS, the City Council desires to create a Department of Building, Permitting and Inspection and a Department of Neighborhood Services and Code Compliance by splitting the functions currently assigned to the Department of Building, Housing and Zoning; and
WHEREAS, the Salisbury City Council intends to amend the appropriate Sections of the City Code to reflect the reassignment of duties and authority to each department.
NOW, THEREFORE, BE IT ENACTED AND ORDAINED BY THE COUNCIL OF THE CITY OF SALISBURY, MARYLAND, in regular session, that Section 1.16.100 is hereby amended as follows:
CHAPTER
1.16
INFRACTIONS
AND CIVIL ZONING VIOLATIONS
Section
1.16.100 Waiver of fines - Authority to issue citations - Violations and
penalties - Repealer.
B. The following persons shall have the
authority to issue citations for municipal infractions or civil zoning
violations:
1. Director of the department of building, housing
and zoning permitting
and inspection;
2. Building inspector Director of the
department of neighborhood services
and code compliance;
2.
3. Housing inspector supervisor;
3.
4. Plumbing Building
inspector;
4.
5. All city police officers Housing
inspector;
5.
6. Director, public works Zoning
administrator;
6.
7. Deputy director of public
works Plan examiner;
7.
8. Superintendent of highways
Plumbing inspector;
8.
9. General superintendent All
city police officers;
9.
10. Foreman solid waste Director,
public works;
10.
11. Chief, deputy chief or
division chief of the Salisbury fire
department. Deputy director public works;
12. Operations & maintenance supervisor;
13. Sanitation superintendent;
14. Chief or deputy chief of the Salisbury
fire department;
AND BE IT FURTHER ENACTED AND ORDAINED BY THE COUNCIL OF THE CITY OF SALISBURY, MARYLAND, that the amendment set forth in this Ordinance shall take effect from and after the date of its final passage.
THE ABOVE ORDINANCE was introduced at a meeting of the Council on the 28th day of November, 2005, and having been published as required by law, in the meantime, was finally passed at its meeting on the ____ day of December, 2005.
